Attorneys for the city of Bakersfield say they will refile a $20,000 motion against 10 residents who sued over the 24th Street Widening project.
A judge dismissed the motion on Friday because it was unclear who was being sued, but city attorney Andrew Heglund says they want to continue to recoup some of the taxpayer money spent fighting the original lawsuit.
Opponents of the motion say it is anti-American to make people pay for standing up to their government and that the city is unfairly charging them for legally required environmental reviews.
